Warranty, Disclaimer and Liability

Supply of Goods

Complete Cruisers supply Goods that we manufacture, and Goods that are manufactured by other parties.

Acceptance of Terms

The Customer is deemed to have read, understood and accepted these Terms if at any time they place an Order for Goods, request a quote for Goods or Services, or pay any deposit or any other monies in relation to an Order.

Complete Cruisers reserves the right to amend these Terms at any time, at its sole discretion, and any subsequent Order by a Customer constitutes acceptance of any changes.

Warranty

The Goods that we supply come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure.

You are also entitled to have the Goods repaired or replaced if the Goods fail to be of acceptable quality.

Where Complete Cruisers are the manufacturer, we warrant that all Goods will be free from defects in material and workmanship. Goods are covered with a warranty of a period of 12 Months from the date of purchase by the Customer. Where Complete Cruisers determines that the warranty applies, Complete Cruisers will, at its discretion, repair, refund or replace the Goods pursuant to its obligations under the Consumer Law.

The Customer will, at their expense, return the Goods to Complete Cruisers for inspection. Complete Cruisers will pay all costs for the return of repaired or replacement Goods to the customer, and at its discretion, any costs for the return of the Goods to Complete Cruisers.

Where Complete Cruisers is not the manufacturer, it warrants that the Goods will be free from defects in materials and workmanship on the same terms and conditions, including the period of warranty, as the warranties provided by the Manufacturer of the Goods.

If the Customer makes a warranty claim, Complete Cruisers may at its option return the Goods to the Manufacturer to be determined by the Manufacturer if a failure of the Goods has occurred.

Should the Manufacturer determine that a failure has occurred, Complete Cruisers will at its election, repair, refund or replace the Goods pursuant to its obligations under the Consumer Law.

Where the Manufacturer determines that no failure of the Goods has occurred, Complete Cruisers will have no liability to the Customer in respect of that claim, other than any guarantee, right or remedy conferred on the Customer under the Australian Consumer Law that cannot be excluded, restricted or modified.

This warranty does not apply to Goods incorrectly chosen or incorrectly fitted by the Customer, on the basis of Customer opinions regarding ride, comfort, installation, design or any other attribute, misuse of the Goods by the Customer or any third parties, use in racing, modification or alteration by the Customer (including welding, attachment of additional parts, grinding etc.), normal wear, or to the extent that the damage is to finish or coating, and occurs after the earlier of the Goods being fitted to the Customer's Equipment, or 60 days after the date of order.

The warranty does not cover labour for installation of original or replacement parts, even where the parts were incorrectly supplied by Complete Cruisers.

Product Selection and Fitment

Complete Cruisers does not provide advice, recommendations or assurances as to the suitability, compatibility or fitment of any Goods to the Customer's vehicle. It is the Customer's sole responsibility to verify that the Goods ordered are correct for their specific vehicle — including make, model, series, chassis number, build date and any relevant modifications — prior to placing an Order. Where the Customer is uncertain of correct fitment, the Customer should seek independent advice from a qualified mechanic or the vehicle manufacturer prior to ordering. Complete Cruisers accepts no liability for any loss, cost or damage arising from the Customer's selection of incorrect or unsuitable Goods.

Disclaimer

The use or installation of Goods sold by Complete Cruisers may render the Customer's Equipment illegal to operate for road use in a state or territory of Australia or any other country. By purchasing and/or installing Goods, the Customer acknowledges and confirms that they have undertaken their own investigation into the legality or otherwise of particular Goods and indemnify and hold Complete Cruisers harmless from and against any Claim as a result of the legality or otherwise of Goods sold by Complete Cruisers.

Liability

Modification to any vehicle by installing Goods supplied by Complete Cruisers or otherwise could alter or adversely affect the vehicle's on-road performance, handling and stability, including but not limited to in the event of a crash, resulting in bodily harm or property damage.

To the extent permitted by law, the Customer indemnifies Complete Cruisers and its representatives from any harm to, claim or action by a third party, any personal injury or death and/or any damage to property, arising directly or indirectly from the Customer's conduct or use of the Goods or Services.

Limitation of Liability

To the maximum extent permitted by law, and subject to any guarantee, right or remedy conferred on the Customer under the Australian Consumer Law that cannot be excluded, restricted or modified, Complete Cruisers' total liability arising out of or in connection with the supply of any Goods, whether in contract, tort (including negligence), under statute or otherwise, is limited, at Complete Cruisers' election, to one or more of: (a) the replacement of the Goods or the supply of equivalent goods; (b) the repair of the Goods; or (c) the payment of the cost of replacing the Goods or of acquiring equivalent goods.

In any event, Complete Cruisers' total liability to the Customer in connection with an Order will not exceed the purchase price paid by the Customer for the Goods giving rise to the claim.

Complete Cruisers is not liable for any indirect, special or consequential loss, including loss of profits, loss of use, loss of time or loss of opportunity, whether or not Complete Cruisers was advised of the possibility of such loss.
